Terms of Use
These Terms of Use (“Terms”) govern your access to and use of the Plyft mobile application and any related services (collectively, the “Service”) provided by Bydino (“Bydino”, “we”, “us”, or “our”). By downloading, installing, or using Plyft you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use Plyft. By using the Service you represent that you meet this requirement. If you are under 18, you confirm that you have obtained parental or guardian consent.
2. Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@bydino.co if you suspect unauthorised access. We reserve the right to terminate accounts that violate these Terms.
3. Subscriptions and Auto-Renewal (EULA)
Plyft offers the following auto-renewing subscription plans through Apple’s in-app purchase system:
- Plyft Pro - Monthly: $14.99 per month. Auto-renews monthly.
- Plyft Pro - Yearly: $99.99 per year. Auto-renews annually.
Both plans include a 7-day free trial. Your Apple ID account will be charged for the first billing period at the end of the free trial unless you cancel at least 24 hours before the trial expires. Subscriptions auto-renew at the end of each billing period unless cancelled at least 24 hours before the renewal date.
You can manage or cancel your subscription at any time in iPhone Settings → Apple ID → Subscriptions. Cancellation takes effect at the end of the current billing period; no partial refunds are issued for unused time. Any unused portion of a free trial is forfeited when a paid subscription is purchased.
Prices are in USD and may vary by country or region. We reserve the right to change subscription pricing with reasonable notice.
These Terms, together with Apple’s standard end-user licence agreement (EULA) available at apple.com/legal/internet-services/itunes/dev/stdeula, govern your use of Plyft as obtained from the Apple App Store.
4. Licence
Subject to these Terms and payment of any applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable licence to download and use Plyft for your personal, non-commercial purposes. You may not copy, modify, distribute, sell, sublicence, reverse-engineer, or create derivative works of any part of the Service.
5. AI-Generated Content and Medical Disclaimer
Plyft uses artificial intelligence to generate personalised workout plans, meal plans, and fitness insights. This content is for general fitness and informational purposes only and does not constitute medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional before starting a new exercise programme, changing your diet, or making decisions about your health, particularly if you have an existing medical condition, injury, or other health concern.
Nutrition guidance in the app is informed by publicly available health and fitness guidelines, including those published by the World Health Organisation (who.int/nutrition) and the American College of Sports Medicine (acsm.org). These sources are incorporated as general reference only; Plyft is not affiliated with or endorsed by these organisations.
You assume full responsibility for your use of any fitness or nutrition content generated by the Service. Bydino is not liable for any injury, illness, or other harm arising from following plans or recommendations in the app.
6. User Conduct
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
- Attempt to gain unauthorised access to any part of the Service or its underlying infrastructure.
- Interfere with or disrupt the integrity or performance of the Service.
- Use automated tools to scrape, extract, or reproduce content from the Service.
- Impersonate any person or entity or misrepresent your affiliation with any person or entity.
7. Intellectual Property
All content, features, and functionality of Plyft - including text, graphics, logos, icons, workout and meal plan formats, and software - are owned by Bydino or its licensors and are protected by applicable intellectual property laws. Nothing in these Terms transfers any intellectual property rights to you.
8. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Plyft you agree to our collection and use of your data as described in that policy.
9. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or usefulness of any AI-generated content.
10. Limitation of Liability
To the fullest extent permitted by applicable law, Bydino and its officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of or inability to use the Service, even if we have been advised of the possibility of such damages.
Our total liability to you for any claims arising out of or relating to these Terms or the Service shall not exceed the amount you paid to us in the 12 months preceding the claim, or $10 USD if you have not made any payments.
11. Indemnification
You agree to indemnify and hold harmless Bydino and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your infringement of any third-party rights.
12. Termination
We may suspend or terminate your access to the Service at any time, with or without cause or notice, at our sole discretion. Upon termination, your right to use the Service ceases immediately. Sections 5, 7, 9, 10, 11, and 13 survive any termination.
13. Governing Law and Disputes
These Terms are governed by the laws of England and Wales, without regard to conflict of law principles. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless applicable consumer protection laws in your jurisdiction require otherwise.
14. Changes to These Terms
We may update these Terms from time to time. We will update the effective date above and, for material changes, provide notice within the app or by other appropriate means. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
